Terms of Service

These Terms of Service ("Terms") are an agreement between you and K Khay("we," "us," or "our"). They govern your use of our websites, account tools, wallet experiences, backtesting tools, and related products and services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

You must be legally able to enter into this agreement and be at least 13 years old. If local law requires a higher minimum age, that higher age applies. If you use the Services for an organization, you confirm that you have authority to bind it to these Terms.

Give us accurate information, keep it current, protect your account credentials and devices, and promptly tell us about suspected unauthorized access. You are responsible for activity under your account except to the extent caused by our breach of these Terms.

We give you a limited, personal, revocable, non-exclusive, non-transferable right to access and use the Services in accordance with these Terms. Features may be experimental, change over time, or be subject to additional terms shown when you use them.

You may not:

• use the Services for unlawful, fraudulent, or abusive activity;
• interfere with security, integrity, availability, or another person's use of the Services;
• access accounts or data without authorization, introduce malicious code, or probe or bypass protective measures;
• scrape, copy, reverse engineer, or commercially exploit the Services except where applicable law expressly permits it; or
• misrepresent your identity, infringe rights, or use the Services to harm others.

The Services may display blockchain data, facilitate interactions with third-party networks or wallets, or provide simulations and backtests. Nothing in the Services is financial, investment, legal, tax, or other professional advice. Backtests and historical results do not guarantee future performance.

Digital assets and blockchain transactions can be volatile, irreversible, and subject to technical, legal, and counterparty risk. You are solely responsible for reviewing transaction details, safeguarding keys and recovery credentials, understanding applicable fees and taxes, and deciding whether an action is appropriate. We do not control third-party networks and cannot reverse their transactions.

The Services may link to or interoperate with providers such as Google, blockchain networks, wallet software, or other sites. Their terms and privacy policies govern your use of their products. We do not control and are not responsible for third-party content, availability, security, or conduct. A link or integration does not imply endorsement.

We and our licensors own the Services, including software, designs, text, branding, and other materials, except for content owned by you or others. These Terms do not transfer those rights to you.

You retain ownership of content you submit. You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display it only as needed to operate, secure, and improve the Services. You confirm that you have the rights needed to provide that content. Feedback may be used without restriction or compensation to you.

We may add, change, suspend, or discontinue features. When reasonably possible, we will give notice of material changes that negatively affect your use. We may suspend or terminate access if you violate these Terms, create risk or legal exposure, or if required by law.

You may stop using the Services at any time. Provisions that by their nature should survive termination—including ownership, disclaimers, liability limits, and dispute provisions—will survive.

To the fullest extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not promise that the Services will be uninterrupted, error-free, secure, or accurate, or that digital assets, data, or content will not be lost. Some laws do not allow certain disclaimers, so portions of this section may not apply to you.

To the fullest extent permitted by law, K Khay and its contributors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, digital assets, or opportunities, arising from the Services. Our total liability for claims relating to the Services will not exceed the greater of the amount you paid us for the Services during the 12 months before the claim or US$100. These limits do not apply where liability cannot legally be limited.

You must comply with laws that apply to your use of the Services, including trade and sanctions rules. If a provision of these Terms is unenforceable, the remaining provisions stay effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization or transfer of the Services.

These Terms and any additional terms presented for a feature are the entire agreement about the Services. Before filing a formal claim, you agree to contact us and try in good faith to resolve the issue. Any dispute will be handled under applicable law and by courts with jurisdiction, unless you and we agree to another lawful process.

We may update these Terms. We will post the revised version, update the date above, and provide additional notice when required. Your continued use after an update takes effect means you accept the revised Terms.
